Terms of Service

The rules for using PixToolery: accounts, credits, payments via Stripe, your content, AI results, liability and how these terms change.

About these terms

These Terms of Service ("Terms") govern your use of PixToolery (https://www.pixtoolery.com, the "Service"), operated by [Operator legal name], a sole operator established at [Postal address], [Country of establishment] ("we", "us"). Contact: [contact email: support@pixtoolery.com — to confirm].

By using the Service you agree to these Terms, our Privacy Policy, our Acceptable Use Policy and our Refund Policy. If you do not agree, do not use the Service.

The Service

PixToolery offers two kinds of tools:

  • Browser tools (compress, resize, crop, convert, watermark and similar), which are free and process your files locally in your browser. Your files do not leave your device.
  • AI tools (background removal, upscaling, restoration, AI photo editor, face swap, AI image detector and similar), which process your images on our servers and through third-party AI providers. AI tools consume credits.

We may add, change or remove tools and features over time. We will try to give reasonable notice of changes that materially reduce what you have paid for.

Eligibility

You must be at least 16 years old (or the age of digital consent in your country, if higher) to use the Service. If you use the Service on behalf of a business, you confirm you are authorised to accept these Terms for it.

Accounts and guest use

  • You can create an account with an email and password or with Sign in with Google. Keep your credentials secure; you are responsible for activity under your account.
  • One person, one account. Creating multiple accounts to obtain extra free usage is not allowed.
  • Guests can try AI tools without an account within a small daily limit, enforced by IP address and Cloudflare Turnstile bot protection. Guest results may be lower resolution or watermarked, and guest files are deleted after 24 hours.

Credits and pricing

  • AI tools are paid for with credits. Credits are sold as one-time credit packs; there are no subscriptions and no automatic renewals.
  • Prices are shown in US dollars, excluding applicable taxes. Taxes (such as VAT or sales tax) are calculated and added at checkout according to your location.
  • The number of credits each tool costs is shown before you run it. We may change pack prices and per-tool credit costs in the future; changes never affect purchases already completed, and the cost shown before you run a job is the cost charged for that job.
  • Each pack is a separate lot, valid for 1 year from its purchase date. When you use credits, the credits that expire soonest are used first. Credits not used before their expiry date are forfeited.
  • Credits have no cash value, cannot be exchanged for money (except as described in our Refund Policy), and cannot be transferred, sold or shared.
  • Larger packs may unlock additional perks, such as longer history retention (for example 30, 90 or 365 days), higher output resolution or larger batch sizes, as described on the pricing page at the time of purchase.
  • Failed jobs: if an AI job fails or times out, the credits used for it are automatically returned to your balance. The refund appears in your history; you do not need to request it.

Payments through Stripe

Payments are processed through Stripe Managed Payments. For your purchase, Stripe acts as the merchant of record (reseller): it sells you the credit pack, collects your payment, calculates and remits applicable VAT or sales tax, and issues your receipt or invoice. The payment transaction is therefore governed by Stripe's applicable terms, while your use of PixToolery and your credits is governed by these Terms. We do not store your full card details.

Your content

  • Ownership. You keep all rights you have in the images you upload and, to the extent the law allows, in the results the Service produces for you. We do not claim ownership of your content. Note that, in some countries, purely AI-generated material may not be protected by copyright.
  • Licence to us. You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, copy, transmit and process your content only as needed to provide the Service to you (including passing it to our AI processors), to keep it for the retention period described in our Privacy Policy, and to enforce these Terms. This licence ends when your content is deleted.
  • No training. We do not use your content to train AI models.
  • Your responsibility. You confirm that you have the rights and, where people are identifiable, the consent needed to upload and edit each image, and that your use complies with our Acceptable Use Policy.

AI results

AI tools are probabilistic. Results may be inaccurate, incomplete, distorted or unexpected, and the same input can produce different outputs. You are responsible for reviewing results before relying on them or sharing them. In particular, the AI image detector gives a probabilistic estimate, not proof that an image is or is not AI-generated. Where the law requires AI-generated or manipulated content to be labelled, you are responsible for labelling it when you share it.

Acceptable use

You must follow our Acceptable Use Policy. It forbids, among other things, non-consensual face swaps and deceptive deepfakes, sexual content, any content sexualising minors, removing others' watermarks or copyright notices, and attempts to bypass limits or abuse the Service.

Our intellectual property

The Service, including its software, design, text and brand, belongs to us or our licensors. You may not copy, reverse engineer, scrape, resell or provide access to the Service or its API except as we expressly allow.

Availability

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may suspend the Service for maintenance, security or reasons outside our control, and third-party AI providers may change or become unavailable.

Suspension and termination

  • You can stop using the Service and delete your account at any time. Deleting your account deletes your files and history; unused credits are forfeited unless a refund applies under our Refund Policy.
  • We may suspend or close your account, remove content, or refuse service if you seriously or repeatedly breach these Terms or the Acceptable Use Policy, if required by law, or to protect users or the Service. For serious breaches (such as illegal content, fraud or chargeback abuse), remaining credits may be forfeited. Where reasonable, we will tell you why and give you a chance to respond.
  • If we close the Service entirely for reasons other than your breach, we will give reasonable notice and refund or otherwise compensate unexpired, unused paid credits [mechanism — to confirm].

Disclaimer

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms limits the legal guarantees that apply to consumers, including the guarantee of conformity of digital content and services where applicable.

Limitation of liability

To the extent permitted by law:

  • we are not liable for indirect or consequential losses, such as loss of profits, data, business or reputation;
  • our total liability to you for all claims relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

These limits do not apply to liability that cannot be limited by law, such as for death or personal injury caused by negligence, fraud, gross negligence or wilful misconduct, or to your mandatory rights as a consumer.

Indemnity

If you are using the Service for business purposes, you agree to compensate us for reasonable losses and costs arising from third-party claims caused by your content or your breach of these Terms. This clause does not apply to consumers to the extent prohibited by law.

Consumers in the EU and UK

If you are a consumer, you benefit from the mandatory protections of the law of the country where you live, and nothing in these Terms removes them. Information about the right of withdrawal for digital content, and how it ends when you ask for immediate access to credits, is set out in our Refund Policy.

Changes to these Terms

We may update these Terms, for example to reflect new features or legal changes. We will update the date above and, for material changes, notify signed-in users by email or on the site at least [30] days before they take effect. If you do not agree, you may stop using the Service and delete your account before the changes apply. Changes do not apply retroactively to purchases already completed.

Governing law and disputes

These Terms are governed by the laws of [Governing law — to confirm], without depriving consumers of the protection of the mandatory rules of their country of residence. Miscellaneous
